As far as I know, for COS(change of status) from one visa type to another visa type( eg F1 to F2, F1 to H4 etc) when one files in USICS, I-94 (either original OR at least a copy must be submitted with the application.
In your wife's case, it's H4 to another H4 (as you said you are changing employer) i.e just transfer of visa but not COS, so I am not sure. Post in murthy.com, it wll definetely help, there you find answers from experts.
Anyway always I-94 is most imp as long as one stays in USA. |

Notice can be given any time.
New employer can mail the application on the same day u join him and u will be covered.

Nothing serious. But they need to have I 94. Think u can apply for duplicate I 94 slip and INS will send u.
But it is expensive affair around $100 |

I need some info regarding the following questions on H1B transfer.
1) When should i give notice to my employer to leave the company i.t either after receiving the new h1b transfer receipt no or can i give notice to him immedeatly after applying for the transfer.
2) If i give notice before receiving the receipt no is there any possibility of my employer cancelling my H1B and me getting into trouble.
3) My companies attorney asked for I94 of my wife and kids also for transfer of H4 but we are not having any I94 for them. After their arrival here in the aiport immigration officer had just put a stamp on their passport but they didnt give any I94 cards thats what my wife said and also as i was not aware of how important this was so i to just neglected about that.
Now my attorney is asking for I94 for them too which we dont have. Then they said they will file for transfer of my H1B and will file for transfer of H4 later.
So are there any problems for my dependent visas if they dont apply for tranfer with my H1B.
Or can they continue on the same h4 which they are having till 2007. |
