Badri, 2004 fiscal year H1B quota reached the cap of 58,000 etc( including non-filled Singapore and Chile). They r not going to accept the applications reached after EOB of Oct1 2004. They will send back those(with the application money). Now one has to wait till april 1, 2005 to apply for next year quota babai. Hope i am clear. |

Pisces babai, If ur OPT is expiring in JUL 05 then one option is ur consultant shud apply for ur H1B now. Hopefully u would get ur offer and the H1B filed before the current H1B quota expires. Don't worry about issuing pay stubs etc etc. U have every right to demand for ur paystubs and inform INS incase one is not paying(this is secondary and can be taken care of). Second option is (if u get ur offer after the current H1B quota expires) just work on ur OPT till July 05 and guage ur situation during next year summer. There shud be some saving grace at that time. Like someone applies for next year H1B quota and gets you the receipt before July05 then legally ur allowed to stay in US till u get ur H1B (but u can't work till that time) and even in the worst possible case u could opt for some university I-20 to just stay in status during that time. Anything is possible in US. So don't get tensed and work ur way through. If u still have doubts try seeing www.murthy.com discussion board. There shud be some answers and u can post ur questions too. oakala and xxx: thanks for the replies. my opt is expiring in july 05. that is why i am trying consultancies now. if i wait for some more time i will definitely get job in chemical industry..but that will be a headache as my OPT expires in july 05 and the h1-b quota will be over with in a week. the consultancy poeple are asking to stay with them for two years. So i dont know whether they will give pay-stubs or not. i dont know what to decide: whether to work till the opt expiry date and expect for the magic to happen (lot of talk is going that students will be exempted from the quota...after the elections). or to get h1 from a consultancy and think about the consequences later. (also unlike IT jobs, chemistry jobs are different... i got two on site interviews this week and they are interviewing more candidates in the coming two weeks. so to hear the news from the companies it will take at least 15+ days. they can't take the decision in this week. and also they are reluctant to allow me to work in the gap "July 05-Oct 05" as they will have problems with insurance as my status will be invalid during that gap. and also they are reluctant to give that many leaves.) please advice. thanks a lot.

You can have as many h1s as you like, there is no restriction, Once you decide to change from H1b to another all you need is paysutb and resume, There is no agreement that You need to stick 2 years etc, Desi companies are such a fraud that may claim expenses for your training etc if you try to leave them, You can ask them to go to hell, Also be careful in signing the offer letter , i.e just in case read what is printed in that offer letter carefully Finally stamping , As long as you dont leave the country , you dont need a visa stamping, visa is just a document to enter the country

Pisces1, I couldn't get ur question completely. One thing is for sure. There is no agreement as such in US. It won't hold good in the court of law. So no need to worry abt that. Now if ur on OPT, u have work permit for another year right. If ur selected in that chemical/pharma company then u can just go ahead and work for them(without consultants H1B). Down the road (after 6 or 7 months) u can think of H1B and can either go with ur present employer or find a new one. Now, consultants r always a headache. If possible try to get that job without consultants help(as u have work permit). Let me know if u still have some doubts. |

I concated a consultancy company (IT) who are ready to sponsor H1B but I have to stay with them for Two Years with them (and it is my responsibility to get job in Chemical instustry as am a graduate student in chemistry). My Questions: --------------------------------- (1) I had an interview in a chemical/pharama and will know about the decision in two weeks and they are ready to sponsor H1 once I get selected and if there is quota left. (If not this year may be for next year they will do). So in this case "Is it ok to get another H1". If so... what happens with the company (IT) that i am getting H1-B now (since there is two years agreement). (2) I am on OPT. The consultany people told me that I dont have to get stamping immediately for H1-B. Once I get H1-B... is there a grace period to get stamping or can I directly start working right after approval of H1-B. please reply.. thanks in advance. |
