The rule is you can get your H-1 stamped (Visa) only before 3 months or 6 months, before the current H-1 (I-797) expires. I'm very sure about it. But, the only point, which I'm not sure is whether you have to wait 3 months or 6 months. Will let you know. |

All: A person has been with a Company A and has obtained a Visa with an expiration date of Dec 15 2006. He then has applied for transfer to Company B effective Jan 2006 and has the original Notice of action 797. In this situation he wants to get his his VISA for the duration og the new H1B. Question: Is there any time limit on when he could appear. I have been told that you would have to wait until you fall within 6 months( June 15, 2006) in this case to appear for a VISA. a) Is this true. b) Is it same for extension with same company and tranfers,. c) Is it any different if we go to our home country.
