Bonguly ga...

One is in valid F1 status typically 60 days after the OPT expiration. The 60 day period is a grace period during which one can stay in the US but cannot work.

- By applying for premium processing, the USCIS will process the case within 15 calendar days. The premium option is possible even if one first files under regular processing, and later decides to "upgrade" to premium.

- The approval of H1B does not mean one can stay and start work as of the approval date. This is because the H1B approval would have a starting date mentioned, which for many would be Oct 1 of a year. So, you would have an early approval due to premium processing, but that does not take effect until the start date mentioned in the petition which for most would only be Oct 1.

- What about the 15 or 20 days gap? Well that depends on whether the approval has an I-94 attached to it or not. If you have the I-94 then it means that the USCIS has pardoned the gap, and you can start work as of Oct 1. This has happened in the past, but that is no gaurantee.

- The 15 to 30 days gap does not really affect future GC processing if it is employment based. This is beacuse of section 245(k) which pardons out of status periods up to 180 days since the time of last entry into US.

- One can stay in the US even after the 60 day grace period if one has a valid H1B petition (or other change-of-status) pending. But then everything depends on whether the approval has an I-94 attached or not.

- Safe bet would be to visit Canada, get an H1B stamp (especially if you have a US degree), enjoy for a few days and then enter the US. Note that one can enter up to 10 days prior to the H1B start date (as long as the visa stamp is valid). That means one can enter on Sept 21, and start work on Oct 1.
