venu gaaru, frankly no one knows what the process is...may be they are approving cases which are "pre-adjudication", also its surprising to know that USCIS is approving cases with 2005(EB2)...also namecheck ani okka major hurdle undi, mee namecheck clear ayindoo check cheyyandi, you can do that via calling uscis or via infopass(veelu edavalu koni saarlu info isthaaru koni saarlu evaaru)...

Naa confusion yentante, asala 2005 August EB2 Labor ante inka date current kaaledu kada(I think EB2 dates are at 2004 April), mari approve chesaru yenti ani! Is there some other logic like if the application for adjustment of status(I 485) is already filed they will go on with the processing?
Nenu 29th September 2005 naa I 485 along with I 140 concurrent gaa file chesa. My assumption was they will do nothing about my I 485, as the dates are not current or my labor date is August 2005. As I assumed till my I 140 approval in 2006 March/April, nothing happened with I 485, but once I 140 got approved, I got RFE on I 485. I again thought okay they are trying to keep my file current with all paper work and they will dump in a shelf. Truly after I replied for I 485 RFE, they kept silent!!! I am surprised to see I 485 approvals now with 2005 labor dates and am confused with the logic behind that.
Throw some light on this!

In 2005 August between the 1st and the 30th, 10 applications(all EB2 were filed in PERM processing). All the 10 labors got approved between 15th August to 29th September. They were accepting concurrent filing of 140 and 485 till 30th September, 2005. All of us filed concurrently by 30th September, 2005.
3 Applicants got approvals of their I 485 in last 1 week!!!!

vidhatha mama, if rejected it will be rejected on the basis of PD not current mama, so you can apply again, only thing is, you might loose ur lawyer fees..also the big announcemnt might be that 140/485 can be applied concurrent, so go for it..you might loose money that too ur lawyer fees only

Did USCIS sent back all the applications they received on July2nd. If they didnt then may be its a good idea to send them now

bhupoathi mama go ahead and get ur documents sent to uscis asap...if rejected(50-50 chances) you might loose ur lawyer fees only, but you can negotiate that with ur lawyer

UPDATE : 7/16/07 2:55 PM EST.
The decision has been reached and the announcement is imminent.
The decision is not exactly what we hoped for (Permanent fix to the issue by allowing 485 filing with visa number availability), but it is PRETTY CLOSE TO THAT. We tried our level best to bring a permanent solution to the issue by getting changes that allow 485 filing without visa number availability.
We have learned that the minimum the relief will apply to whoever wishes to apply in July.
Whoever has their 485 ready, PLEASE FILE ASAP. If you have labor approved, then DONT WAIT ANOTHER SECOND, please file your 485 (or 140 and 485 concurrently if your 140 is not filed).
If you havent begun your preparation, start preparing now to file 485 asap.
As soon as we learn more details, we will let you know. Right now, the lawyers in the government are reviewing the draft of the final decision that will be announced shortly.
