Normally they grant H1 Extension for 3 years.
In Hemu's case he got 3 years.
His Passport doesn't have 3 years for the immigration officer to give 3 years I94, so he gave upto passport expiry date.
In your case u will get 3 year H1 extension and if don't travel then no problem.
U will apply for new passport and when u go out then u will be good.
But if u go for VISA in like Jan or Feb 2009.
I think he might just give VISA and I94 upto Dec2009 since your passport that day.
Or they might give u visa upto your H1 valid period.
It varies from officer to officer.
It is a total mess.

Hemu Maama.
When u entered at the immigration check they gave u I94 only until your passport expiry date and not your H1 expiry date.
So right now u have only one I94 , u got when u entered and the one u got with your H1 was returned when u left the country.
So u will need to talk to your attorney and they will need to refile your H1B so that u get a new I94.
That is the best and easy way.
If u do contracting and pay for your H1B then it is lot of money.
If it is your company paying for u, then let them do it.
Other option is going out and getting new I94 which might a little risk and headache as said by others.
