#1. H1B transfer chesukovachu India nunche without any stubs and can enter into USA with new approved petiion copy along with old stamp(if it is not expired).
#2. and even you can do that in USA without paystubs(if it only before 30days or so) But needs to go for stamping if(not sure though abt stamping)

if you are not working obviously you are out of status, and have to go back. Payroll generate avvali as long as you are in USA.

there are case by case approvals which differ in the way they are treated. In general once you have a H1, I guess until 3 or 4 years of visa expiration, you can get approved without getting into lottery even though you are not working. But that doesnt come as transfer, will be treated as new application but without getting into lottery. Once it is passed beyond that date, they have to get into lottery.

1. Not sure of restamping. But company B has to apply with Uscis as applicant never entered USA. I think you can use existing visa stamp but need new I797 from company B.
2. Doesn't come under lottery. If you want change the company from India, they can send H1 reinstatement to uscis showing earlier stamping with other company. |

Inka anytime you change your employer you will have to get re stamped if you go out of country. If you are in USA when you change employer you can stay with change of employer as you get new I-94.
Inka first H1 expire ayyi, if you didn't work and then apply another H1 after getting stamped it will not come under lottery but after getting H1 approved you will have to go for stamping again before entering usa

H1B applied for 2015 quota with employer-A
After approval and stamping in 2015.
Scenario:
After 2 Years, in 2017,Got offer from employer-B.
is transfer possible (with out entry to US after stamping)?
If restamping is required, will it go through regular application process again? with lottery or w/o lottery?
Scenario-2:
After stamping and no entry to US, say VISA expired (3 years passed by), say after October-2018, can the applicant go through transfer / fresh application ?
will that come under lottery? Is that possible with a different employer? |
